Terms and Conditions of Supply

This page together with our Privacy Policy and Website Policy tells you information about us and the legal terms and conditions (Terms) on which we sell any of the products (Products) listed on our website to you.

These Terms will apply to any contract between us for the sale of Products to you (Contract). Please note that by ordering any of our Products, you agree to be bound by these Terms and the other documents expressly referred to within them.

We amend these Terms from time to time as set out in paragraph 4. Every time you wish to order Products, please check these Terms to ensure you understand the terms and conditions which will apply at that time.

We only make these Terms available in the English language.

Digital training subscriptions

Cost

Facts4Life Digital Training is a subscription product. There are currently two options available for users:

Subscriptions run from the date of sign up for the requested period (subject to receipt of payment or an approved purchase order). We are currently able to provide our training and resources fully funded to settings within Gloucestershire however this may be subject to change in the future at the end of each financial year. We reserve the right to increase the cost of training subscriptions, and this will be communicated to subscribers at the time of renewal.

Resources available

We have created a variety of digital subscriptions based on the age group of your setting. Each subscription level will provide access to different resources and more details on what your specific subscription includes can be found by visiting our Digital Training hub and clicking on the relevant course (https://facts4life.org/digital-training/).

Payment terms

Once a subscription form has been completed, an invoice will be sent using the setting details provided on the form. We operate strict 30-day payment terms and reserve the right to withdraw access to your online account if payment is not made within that period.

Intellectual property

The Facts4Life website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Fair usage policy

Each Facts4Life subscription is for a specific setting. You will be provided with a setting specific username and password, giving access to the resources you have signed up for. This username and password may be shared with others employed within your setting but not with anyone else (i.e. parents, colleagues from other settings or organisations, students etc). We reserve the right to suspend your subscription for all users if we believe the login details and/or content has been shared in this way.

Training sessions

We offer a range of training sessions, both online and face to face. These sessions are fully funded for Gloucestershire based settings and at a small cost to delegates from outside the county. In signing up to a training session with us, you agree to accept the terms and conditions below.

 

Face to face training

Amending your booking for a face-to-face training session

  • If a delegate is unable to attend a session which has been booked, it may be possible, by agreement with Facts4Life, to send a replacement delegate from the same setting.
  • If a delegate is unable to send a replacement, the delegate can request, subject to availability, to move the booking to another date within six months of the original booking.
  • All changes must be made seven working days prior to the training session. Any changes made after this may incur a £25 charge to cover the costs we have incurred to provide your training.

Cancellation of face-to-face training by Facts4Life

  • Should a course have insufficient numbers to run, Facts4Life reserves the right to cancel a course up to 14 days before it is scheduled to take place. Should this occur, an alternative date or course will be offered.
  • If Facts4Life is forced to cancel a training session due to circumstances beyond their control and without 14 days’ notice, an alternative date will be provided to all delegates booked on that course.

Cancellation of face-to-face training by Participant

Participants can amend their booking (see ‘Amending your booking’ above) up to seven working days before a course is due to take place. Our courses are very popular so please give as much notice as possible if you are no longer able to attend so that the place can be offered to another delegate. Cancelling a place less than seven working days prior to the session may incur an administration fee of £25 to cover our costs.

Non-attendance at a face-to-face training session

Whilst we do not charge delegates from within Gloucestershire to attend our training, each course we run has a cost involved. Non-attendance at a fully funded face to face course may lead to an administrative ‘no-show’ charge of £25 (invoiced to your setting) to cover administration costs (including venue hire, refreshments and trainer costs).

Online training

Attending an online training session

  • Each delegate should use a separate screen/device for online training, unless otherwise agreed with Facts4Life in advance. This allows you to be able to take part easily and for the trainers to fully engage with each attendee.
  • Cameras must be on throughout an online training session, unless agreed in advance or the trainer requests for them to be turned off.

If these conditions are not adhered to, the delegate may be asked to leave the training or be removed from the online session.

1.1 We are Facts4Life, a company registered in England and Wales under company number 08289917 and with our registered office at 13 Lampern View, Uley, Dursley, Gloucestershire, GL11 5TD.

2. Our Products

All Products shown on our website are subject to availability. We will inform you by e-mail as soon as possible if the Product you have ordered is not available and   we will not process your order if made.

3. How the Contract Is Formed Between You and Us

3.1 To place an order on our website, please see our Purchase Page.

3.2 Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each stage of the order process.

3.3 After you place an order, you will receive a receipt of order confirmation email. The Contract between us will only be formed when you receive this confirmation.

3.4 Once the products have been dispatched, we will send you a second email confirming that your order has been completed.

3.5 If we are unable to supply you with a Product, for example because that Product is not in stock or is no longer available, or because of an error in the price, we    will inform you of this by e-mail and we will not process your order. If you have already paid for the Products, we will refund the full amount to you as soon as       possible.

4. Our Right to Vary These Terms

4.1 We may revise these Terms from time to time for legal or regulatory reasons, or to reflect changes in our business practices.

4.2 Every time you order Products from us, the Terms in force at that time will apply to the Contract between you and us.

4.3 Whenever we revise these Terms in accordance with this paragraph, we will keep you informed by stating at the top of this page that these Terms have been amended and the relevant date.

5. Delivery

5.1 Please see our Purchase Page for more information on our various delivery options.

5.2 Delivery will be completed when we deliver the Products to the address you gave us. The Products will be your responsibility from the completion of delivery.

5.3 You own the Products once we have received payment in full, including all applicable delivery charges.

6. International Delivery

6.1 If you order Products from our website for delivery to one of the International Delivery Destinations, your order may be subject to import duties and taxes which are applied when the delivery reaches that destination. Please note that we have no control over these charges and we cannot predict their amount.

6.2 You will be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information before placing your   order.

6.3 You must comply with all applicable laws and regulations of the country for which the Products are destined. We will not be liable or responsible if you break   any such law.

7. Price of Products and Delivery Charges

The price of a Product does not include delivery charges. Our delivery charges are as quoted on our website.

8. How to Pay

8.1 You can pay for Products using Visa, American Express and Mastercard.

8.2 Payment for the Products and all applicable delivery charges is in advance. Your debit card or credit card will be charged upon receipt of your order.

9. Your Right of Return and Refund

9.1 If you are not happy with an item you’ve ordered then just return it to us in fully resaleable condition within 28 days from the date of the completion of the order for an exchange or refund in accordance with this paragraph 9. 9.2 If you return Products to us:

9.2.1 You must return the Products in fully resaleable condition as soon as reasonably practicable.

9.2.2 You will receive a full refund of the price you paid for the Products plus any applicable delivery charges. Please note that we are unable to refund delivery   charges for Products which have been delivered to an International Delivery destination.

9.2.3 Unless the Products are faulty or not as described, you will be responsible for the cost of returning the Products to us.

9.2.4 We will process the refund due to you as soon as possible and, in any case, within 30 calendar days of receiving the returned Products.

9.2.5 We will make the refund to the credit card or debit card used by you to pay.

9.2.6 If you are returning faulty Products, we will also refund any reasonable costs you incur in returning the item to us.

10. Events Outside Our Control

10.1 If, for reasons outside our control, we are unable to deliver the Products to you:

10.1.1 we will contact you as soon as reasonably possible to notify you; and

10.1.2 Facts4Life shall have no liability to you for any failure to deliver goods you have ordered, or any delay in doing so, or for any damage or defect to goods   delivered, that is caused by any event or circumstance beyond its reasonable control.

11. Data Protection

11.1 In order to comply with our obligations under our Contract with you and to deliver Products to you, we will need to process certain personal information about you. We will only use your personal information as set out in our Privacy Policy and in accordance with all applicable data protection legislation, including the General Data Protection Regulation and the Data Protection Act 2018.
